Terms of Use
By accessing or using FastCat services, you agree to these Terms of Use.
Your Account
Account Requirements
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use FastCat services. You agree to provide accurate and truthful information when creating your account and to keep it current. Accounts found to have willfully false or misleading information may be suspended or terminated.
Multiple Accounts
You may operate multiple FastCat accounts. Multiple accounts may not be used to abuse promotions or otherwise be used fraudulently, or to circumvent account closures or suspensions.
Billing & Payment
Invoices are issued at least one week before their due date. If an invoice is not paid:
- Your service will be paused 2 days after the due date
- Your service will be permanently deleted 14 days after the due date
To avoid unwanted charges, cancel your service through the billing panel before the due date. See our Refund Policy for information on refunds.
Acceptable Use
Prohibited Activities
You may not use FastCat services for any of the following:
- DDoS attacks or any form of network disruption
- Phishing, spoofing, or impersonation
- Unauthorized access to or probing of systems or networks you do not own
- Deploying software or infrastructure intended to disrupt, compromise, or gain unauthorized access to systems
- Hosting or distributing content that is illegal under US law
- Copyright infringement or piracy
- Any other activity that violates applicable US or local law
Email sending is permitted on our services for legitimate purposes. Bulk unsolicited email and spam are not permitted under any circumstances, regardless of service type. Port 25 may be restricted on services if abuse is reported.
Abuse Response
If we receive an abuse complaint related to your service, you must respond within 24 hours. Failure to respond may result in suspension. Repeat abuse may result in permanent account termination.
FastCat reserves the right to pause or terminate services due to abuse reports, especially when severe or frequent.
Our Services
Service Termination
FastCat reserves the right to suspend or terminate your service at any time, with or without notice, for violations of these terms or other reasons at our discretion. Where possible, we may provide 30 days’ notice for non-violation-related matters.
Data Responsibility
We are not responsible for any data loss across our services. We strongly recommend maintaining your own backups at all times. Any backups we may provide are best-effort and are not guaranteed.
Hardware Substitution
For dedicated server customers, FastCat may substitute listed hardware components with equivalent or higher-performing alternatives when needed — such as during a hardware failure or replacement. CPU product families will not be interchanged without your consent.
Legal
Limitation of Liability
To the fullest extent permitted by law, FastCat’s total liability for any claim arising out of or related to these terms or your use of our services will not exceed the amount you paid for the relevant service in the 30 days prior to the claim. We are not liable for indirect, incidental, or consequential damages of any kind. Our SLA sets out the specific remedies available for service availability issues.
Disclaimer of Warranties
FastCat provides services on an “as-is” and “as-available” basis. We make no warranties, express or implied, beyond what is expressly stated in our SLA and other published policies.
Indemnification
You agree to indemnify and hold FastCat harmless from any claims, damages, or expenses — including reasonable legal fees — arising from your use of our services, your violation of these terms, or harm caused to any third party through your service.
Changes to Terms
We may update these terms at any time. Continued use of our services after changes constitutes your acceptance of the new terms. We may send email notice for significant changes.
Governing Law & Disputes
These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising under these terms shall be resolved in the state or federal courts of Suffolk County, Massachusetts, and you consent to personal jurisdiction in those courts.
